Indiana Teacher Faces Divorce After Sex Abuse Charges

A teacher in Indiana is facing divorce after being accused of sexually abusing multiple underage boys while wearing masks from the horror movie Scream. Brittany Fortinberry, 33, officially split from her ex-husband, Nicholas Fortinberry, on Monday. The separation was formalized over a year ago when he filed to end the marriage, according to court documents seen by TMZ.

Fortinberry is now facing 47 charges. These include 15 counts of child molestation and 14 counts of sexual misconduct with a minor following an investigation that started in August 2024. The settlement shows she will keep her clothes, shoes, and makeup. Nicholas Fortinberry walks away with a 2022 Chrysler Pacifica and a Toyota 4Runner. They sold their home and divided the cash from the sale between them.

Because of Brittany's incarceration, Nicholas was granted sole legal custody of their child. She will get custody back when she is released, with no further restrictions on that transfer. He first filed for divorce in February 2025 after the criminal probe began during their almost five years of marriage.

The investigation started after a teenager's grandmother reported that her grandson had been molested at age 15. More than just isolated reports emerged as additional alleged victims from Eminence High School came forward to tell police that the married teacher sent them explicit messages and graphic pictures.

One allegation stands out for its sheer strangeness. A boy who came forward after her February arrest said Fortinberry insisted he and his friends wear a 'Scream' mask during their encounters. This was a direct reference to the Ghostface killer from the horror movie franchise. An affidavit obtained by the Daily Mail confirmed that this bizarre detail surfaced in the investigation.

The trouble started when a grandmother reported that her 15-year-old grandson had been molested, sparking the probe into Fortinberry's conduct. After the allegations hit the headlines in August 2024, she was immediately suspended from Eminence schools and resigned just one day later. The former teacher faced a staggering list of accusations following her arrest in February 2025. She was initially charged with 29 counts covering offenses like child molesting, sexual misconduct with a minor, sharing harmful material to minors, and contributing to juvenile delinquency.

Prosecutors kept adding to the pile. In April of that same year, they filed a dozen more charges. They added yet another batch in September, pushing the total count up to 47. The severity of these accusations means that if convicted, she could spend the rest of her life behind bars.

The details in the probable cause affidavit from Morgan County Sheriff's Office Detective Sergeant Patrick Williams paint a grim picture. In one instance, a now-13-year-old alleged victim said Fortinberry picked him and two friends up to go to the mall before calling their parents to ask if they could spend the night there. Once at her place, the boy claimed she ordered them all to have group sex with her despite every single person being underage.

'The affidavit states that Brittany had one condition for them to have the gangbang with her and that was that they had to wear a Scream mask,' the documents read. Another victim told police that Fortinberry raped him while her young son slept nearby on a couch at the end of the bed. The boy explained that her son really wanted to stay in the room, laying down on the couch while they watched a show until he fell asleep. At that point, he would move into the bed with Fortinberry and then ask for sex.

Fortinberry has offered explanations that sound unbelievable but were part of her defense strategy. She previously blamed her actions on her weight loss, claiming she regretted losing 150 pounds and saying she would have acted differently if she had kept more weight on. She pleaded not guilty to the charges. The case is still ongoing as authorities work through the massive amount of evidence gathered from these multiple victims.
