Former FBI Director James Comey faces a new federal indictment issued Tuesday by the United States Department of Justice, marking the second time he has been charged in connection with the investigation into President Donald Trump's 2016 campaign. This legal action follows the collapse of a previous criminal case against Comey last year, which was dismissed after a judge ruled that the prosecutor had been improperly appointed.

The current charges stem from a social media post Comey shared nearly a year ago, depicting seashells arranged on a beach to form the numbers "86 47." Prosecutors argue that while "86" is restaurant slang for discarding items, it is also used as a threat to "kill." The indictment accuses Comey of knowingly and willfully making a threat to "take the life of, and to inflict bodily harm upon" the 47th president, as well as transmitting that threat in interstate commerce.

In response to the post, Comey stated he opposed violence and removed the image after learning that some associates the numbers with violent intent. He told investigators he did not know that "some folks associate those numbers with violence." However, the indictment does not claim Comey intended to harm the president; instead, it relies on the argument that a reasonable person familiar with the context would interpret the message as a threat to do harm.

This development comes amidst a broader political landscape where President Trump has repeatedly called for the prosecution of his political opponents, specifically targeting Comey, who led the early investigation into potential coordination between Trump's campaign and Russia. The Justice Department is also moving forward with a separate criminal investigation into former CIA Director John Brennan, another central figure in the Russia probe, though Brennan has denied any wrongdoing.

The legal situation also involves former New York Attorney General Letitia James, whose bank fraud charges were dropped by the same court that dismissed the earlier case against Comey. Prior to these announcements, President Trump had publicly pressured then-Attorney General Pam Bondi to indict Comey, James, and others.
